By engaging in our services you agree to the following Terms and Conditions.

General Information

  • Picnic and Play is a registered sole trader business operating in Perth, WA, providing nature-based play sessions for children and families.

  • The business is owned and operated by Tahlie Wansbrough, referred to as "the business owner" in this document.

  • By attending any Picnic and Play sessions, participants agree to the terms and conditions outlined in this policy.

2. Public Liability

  • Picnic and Play holds public liability insurance covering participants and visitors for injuries or damages that may occur during the event or while on the premises.

  • The insurance policy does not cover injuries caused by negligence or failure to follow the instructions of the session facilitators.

3. Participant Responsibilities

  • Parents and guardians are responsible for supervising their children at all times during Picnic and Play sessions. The business is not responsible for unsupervised children.

  • Parents/guardians must disclose any medical conditions, allergies, or special needs of the child prior to attending the session.

  • Children and adults participate in activities at their own risk, and the business cannot be held responsible for injuries or accidents that occur as a result of participation.

4. Safety and Equipment

  • All materials and equipment used in Picnic and Play sessions are regularly checked for safety and cleanliness. However, parents/guardians are encouraged to supervise their children closely and ensure that all materials are used as instructed.

  • The business ensures that all activities are designed to be age-appropriate and safe for children; however, inherent risks may be associated with nature-based activities. By attending, parents/guardians accept these risks.

5. Weather and Cancellations

  • Sessions will be held outdoors unless extreme weather conditions (such as heavy rain, storms, or extreme heat) pose a safety risk. The business reserves the right to cancel or reschedule a session in such cases.

  • If a session is cancelled by the business due to weather or unforeseen circumstances, participants will be notified as soon as possible. A full refund or rescheduled session will be offered.

  • Picnic and Play does not offer refunds or credits for cancelled bookings. If participants wish to cancel or do not show up to the session, they will forfeit their booking, regardless of the notice period provided. Cancellations made by participants are unable to be refunded or rescheduled.

6. Photography and Media

  • The business may take photographs or videos during Picnic and Play sessions for marketing purposes, including social media and promotional material.

  • By attending a session, participants consent to be photographed or recorded unless they explicitly opt out by informing the business prior to the session.

  • All intellectual property, including photographs and videos taken by the business, remain the property of Picnic and Play and may be used at the discretion of the business owner.

7. Health and Hygiene

  • The business is committed to maintaining high health and hygiene standards. All equipment is cleaned before and after sessions to ensure a safe environment for children.

  • Any child displaying symptoms of illness, including fever, vomiting, or contagious diseases, should not attend the session. The business reserves the right to refuse entry to any child who appears unwell to protect the health of others.

8. Liability Waiver

  • By participating in a Picnic and Play session, parents/guardians agree to release and hold harmless the business, its owner, employees, and contractors from any and all liability, claims, or demands that arise from participation in activities, whether on the premises or at external locations, except in cases of gross negligence or misconduct by the business owner.

  • This waiver includes but is not limited to injury, property damage, or loss as a result of participating in Picnic and Play sessions.

9. Payment Terms

  • Payment for sessions must be made in full at the time of booking to secure a spot. Failure to complete payment within the designated time frame may result in forfeiture of the booking.

  • Refunds will only be provided in accordance with the cancellation policy outlined above.

  • The business reserves the right to change session fees at any time. Participants will be notified in advance of any price changes.

10. Compliance with Local Laws

  • The business complies with all relevant local, state, and national regulations regarding public safety, child protection, and business operations.

  • Parents and guardians must adhere to any rules and guidelines provided by the business, including but not limited to environmental conservation, behaviour expectations, and use of materials.

11. Dispute Resolution

  • Any disputes or complaints regarding the services provided by Picnic and Play should be raised with the business owner in writing. The business will make every effort to resolve disputes amicably.

  • In the event that a dispute cannot be resolved directly, the parties agree to mediate the matter before pursuing legal action.

12. Amendments to the Policy

  • The business reserves the right to update or modify this policy at any time. Participants will be notified of any significant changes in advance, and continued participation in sessions after such updates implies acceptance of the revised policy.

By attending any Picnic and Play session, you acknowledge that you have read, understood, and agree to abide by the terms and conditions outlined in this policy.
